Cookies and similar tracking devices will be subject to a new transparency requirement - anyone that employs these kinds of devices must provide information on them and allow subscribers or users to refuse to accept them if they wish. Anyone receiving SMS messages from you should have a clear indication of where the message came from and a clear method to unsubscribe from your service. It would seem therefore that apart from any other considerations, there are many potential legal pitfalls to setting up your own e-marketing system.
